MURDER, HOMICIDE AND DEATH PENALTY
Charles G. White’s experience with murder, homicide and death penalty cases goes back to 1979 when he was a Certified Legal Intern with the Miami-Dade State Attorney’s Office where he received his training working with the top homicide prosecutors in the office. He assisted prosecutors responding to the “video intoxication” defense, and the case that recognized battered spouse syndrome as a legal defense to premeditated murder. He later prosecuted murder cases as an Assistant State Attorney.
As a criminal defense lawyer, Charles G. White, has defended over 100 murder cases, including those when the State is seeking the death penalty. These include “Skipper” Horton, the Fort Pierce man accused of participating in the murder of two police officers during a drug bust gone bad, and Michael Locascio, whose trial for the murder of his sister-in-law in her Coral Gables home was featured on Dateline NBC. Recently, he was able to obtain a jury acquittal in a murder case where the defendant was identified at the scene by video and, according to police, had confessed. Mr. White has demonstrated over and over again that he has the experience and knowledge necessary to defend a murder case.
In order to successfully defend homicide cases, a defense attorney must be experienced and knowledgeable in challenging crime scene evidence: DNA, fingerprints, gun powder residue tests, rape kits, blood spatter analysis as well as challenges to the Medical Examiner’s testimony relating to cause and circumstances of death. The reality with the evolving standards for the admission of expert testimony, such as the use of the Daubert standard, to legal defenses such as self-defense, and “Stand Your Ground”, is key to a successful defense in a homicide case.
Charles G. White has, in the course of defending over 100 homicide cases, has developed firm legal skills in all of these areas, including asserting innovative and effective defenses on the facts and evidence before a jury. He believes that assembling a team of investigators, and forensic experts, to review the prosecution’s evidence, locate witnesses and help develop a winning theory of defense. Due to the thoroughness of his preparation for trial, Mr. White has been able to persuade the prosecution into dismissing three first-degree murder cases.
Mr. White has not only tried to a jury dozens of homicide cases, he has also represented defendants facing Racketeering charges involving murders, brought against such groups as the Outlaws Motorcycle Club, the Yahwehs, and the Almighty Latin King and Queen Nation (Latin Kings), and the John Does Gang.
