Sometimes, particularly when a foreign national is facing charges in the United States, they can be arrested in their own country. The United States will seek to extradite them if there is an Extradition Treaty between the two countries. The extradition process should not be wasted. It is an opportunity to begin to develop a strategy for defending the case. Effective representation in international extradition requires both an understanding of American extradition laws, and the treaties that have been negotiated with other countries, but an understanding of the law in a country from whom the United States wants to extradite the defendant from. For instance, there is almost a universal rule in extradition that no country will extradite one of its citizens to face charges in the United States if the offense for which they are to be tried is not a violation of its own laws.
