IDENTITY THEFT

Possessing, creating, displaying or distributing false identification, otherwise known as identity theft, can be punished up to 15 years in Federal prison. If the false identification documents are used to facilitate drug trafficking or crimes of violence, the maximum term of imprisonment increases to 20 years. 18 U.S.C, Section 1028. Pursuant to Title 18, United States Code, Section 1028A, if the false identification is used to commit fraud, there is a two-year minimum mandatory prison sentence that must be served consecutive to any other sentence imposed for the fraud.

Federal law enforcement usually focus on identity theft cases that involve the obtaining of confidential identification information from medical offices, clinics and hospitals, businesses that keep credit information and even the credit card companies themselves, and from the internet.
